In 1843, Reform rabbi Samuel Holdheim (1806-1860) published his landmark work, Über die autonomie der Rabbinen und das Princip der jüdischen Ehe, which argued that the Jewish marriage ceremony (Kiddushin) is merely a form of monetary acquisition (Kinyan); as such, per the Rabbinic adjunct of “the law of the land is law” (Dina D’Malchuta Dina), he proposed that marriage should no longer be legislated by Rabbinic law, but rather by the State’s law, and thus pave the way for intermarriage. Rabbi Samson Raphael Hirsch published this short polemic strongly criticizing Holdheim’s stance and refuting his Halachic argument.
